Terms of Use

Welcome to our platform! These Terms of Use govern your relationship with us as the operator and the manner in which you may use the platform, its content, and its features. They are supplemented by our General Terms and Conditions, which govern all paid services, as well as our Privacy Policy. By registering and each time you use the platform, you agree to these terms.

§ 1 Scope and Subject Matter of the Contract

These Terms of Use apply to all individuals who use the platform–including both members and creators who provide their own content.

The purpose of these Terms is to provide a community platform through which Creators can publish digital content (e.g., photos, videos, live streams, messages) and Members can view and interact with that content. For paid services, the Terms and Conditions apply in addition; in the event of any conflicts, the Terms and Conditions shall take precedence with regard to the commercial matters governed therein.

§ 2 Eligibility Requirements and Legal Age

The platform contains adult content and is intended exclusively for adults aged 18 and older (or for individuals who are of legal age under the laws of their country of residence, if that country stipulates a higher minimum age).

By using the platform, you confirm that you are of legal age and have full legal capacity. We reserve the right to verify your age at any time through an age verification process and to block access until your age is successfully confirmed. It is prohibited to grant minors access to your account or to content on the platform.

§ 3 Registration and User Account

You need a user account to access most features. The following applies:

  • You must provide accurate and complete information and keep it up to date.
  • Each person may generally maintain only one account. Transferring or selling your account to third parties is not permitted.
  • You must keep your login credentials confidential and not share them with anyone. You are responsible for all activities that take place through your account.
  • If you suspect unauthorized use, you must notify us immediately so that we can protect your account.

§ 4 Rules of Conduct and Fair Use

We want to create a safe and respectful environment. When using the platform, you agree in particular to:

  • treat other users and creators with respect and not to harass, threaten, or coerce anyone;
  • not to use automated processes (bots, crawlers, scrapers) to extract content or data or to overload the system;
  • not to circumvent technical protective measures or exploit security vulnerabilities;
  • not to disrupt the operation of the platform or distribute malware.

§ 5 Prohibited Content and Actions

It is strictly prohibited to upload, publish, send, or request content, as well as to engage in actions that specifically involve the following:

  • Depictions of minors or of individuals intended to appear to be minors. Such content will be removed immediately and reported to the appropriate authorities.
  • Content created or distributed without the express consent of all persons depicted (e.g., secret recordings, so-called “revenge porn”).
  • Depictions of non-consensual acts, serious violence, coercion, and animal cruelty.
  • Hate speech, discrimination, incitement to violence, or threats.
  • Fraud, phishing, spam, pyramid schemes, and other illegal activities.
  • Infringements of third-party copyrights, trademarks, or personality rights.
  • The publication of third parties’ personal data without their consent (doxxing).
  • Encouraging users to circumvent the platform, such as by processing payments outside the designated payment channels.

§ 6 User-Generated Content and Grant of Rights

The following applies to content that you upload or publish yourself ("User Content"):

  • You retain ownership of the rights to your User Content.
  • You warrant that you have all necessary rights and that all persons depicted are of legal age and have consented to being photographed and published. You must retain the relevant documentation (e.g., proof of consent and proof of age) and provide it to us upon request.
  • You grant us a non-exclusive license, limited in scope and duration to the period during which the content is made available, to use your User Content for the operation, display, and promotion of the platform. This includes technically necessary steps such as storage, transcoding, and the creation of thumbnails.
  • If you delete content or your account, this license terminates, except for retention required by law and copies already delivered to authorized users.

§ 7 Rights to Platform Content

The content provided on the platform–in particular, content created by creators, as well as the platform’s design, software, and trademarks–is protected by copyright and related rights.

Access is granted to you solely for personal, non-commercial use. Downloading, reproducing, making content publicly available, or redistributing it is prohibited without express consent. In particular, recordings, screenshots, and screen captures of paid or live content are not permitted and may result in civil and criminal liability.

§ 8 Tips, Virtual Services, and Purchases

Certain features are subject to a fee, such as memberships, one-time purchases, tips, or paid live content. The details, prices, and right of withdrawal are set forth in the Terms and Conditions.

To the extent that virtual services or credits are offered on the platform, these do not constitute legal tender and–unless expressly provided otherwise–are not redeemable for cash or transferable to third parties. Tips are voluntary contributions to creators and become binding upon submission.

§ 9 Reporting Violations and Moderation

If you notice any content that is illegal or violates these Terms, you can report it at any time using the reporting feature or by emailing report@mia-media.example.

We review incoming reports and investigate them as part of a notice-and-action procedure (in accordance with the Digital Services Act). We remove or block illegal content; in serious cases, we notify the relevant authorities. There is no right to the publication of specific content.

§ 10 Suspension and Termination

In the event of violations of these Terms of Use or applicable law, we may–depending on the severity–remove content, issue a warning, restrict features, or suspend your account temporarily or permanently. In the event of serious violations, your account may be suspended without prior notice and without a refund of any fees already paid.

You can delete your account at any time. Cancellation of paid services is governed by the Terms and Conditions.

§ 11 Liability

We provide the platform’s technical infrastructure. The content published by creators and users does not originate from us; we assume no liability for its accuracy, legality, or quality.

We are liable without limitation for willful misconduct and gross negligence. In cases of simple negligence, we are liable only for breaches of material contractual obligations (cardinal obligations) and only to the extent of foreseeable damages typical for this type of contract. Liability for injury to life, limb, or health, as well as liability under the Product Liability Act, remains unaffected by this provision.

§ 12 Exemption

If you culpably violate these Terms of Use or the rights of third parties, you shall indemnify us against all resulting claims by third parties. This also includes the reasonable costs of the necessary legal defense. Your obligation shall not apply to the extent that you are not responsible for the violation.

§ 13 Changes to the Terms of Use

We may amend these Terms of Use if our services, the legal landscape, or the technologies we use change. We will notify you of any material changes in a timely manner, for example via email or through a notice on the platform. If you do not object within the specified period and continue to use the platform, the amended terms will be deemed accepted. We will specifically inform you of your right to object and the consequences in the notification.

§ 14 Final Provisions

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of your country of residence remain unaffected.

Should any provision of these Terms of Use be invalid, the validity of the remaining provisions shall remain unaffected. The European Commission provides a platform for online dispute resolution, which you can find at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
